Automotive electrical work being carried out under the bonnet of a vehicle

1. About these terms

These terms of service govern the supply of auto electrical repair and installation services by Capaciwerks Auto Electrical Pty Ltd (ABN 65 702 625 269) (“we”, “us”, “our”) to you (“you”, “your”). By requesting a quote, booking a service, or authorising work on your vehicle, you agree to be bound by these terms. If you do not agree with these terms, please contact us before proceeding.

2. Quotes and estimates

All quotes provided by us are estimates based on the information available at the time of assessment. Quotes are valid for 14 days from the date of issue unless otherwise stated in writing. Where further faults are discovered during the course of the work, we will advise you before carrying out any additional work that incurs extra cost. Written approval will be required before any variation to an agreed quote is performed.

3. Payment terms

Unless prior credit arrangements have been agreed in writing, payment in full is due on collection of your vehicle. We accept payment by the methods stated on your tax invoice. Parts and materials supplied as part of the work remain the property of Capaciwerks Auto Electrical Pty Ltd until payment is received in full. Any invoice that remains overdue may be referred to a debt collection service, and reasonable recovery costs may be added to the amount owing.

4. Workmanship and parts warranty

Our repair and installation work is covered by a workmanship warranty of 12 months or 20,000 kilometres, whichever occurs first, from the date of completion. Parts and components supplied by us are covered by the applicable manufacturer’s or supplier’s warranty. The warranty does not cover damage caused by misuse, accident, unauthorised modification, or normal wear and tear. Warranty claims should be directed to us by email so the work can be assessed.

5. Your rights under Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law, being Schedule 2 of the Competition and Consumer Act 2010 (Cth), and equivalent Victorian legislation including the Australian Consumer Law and Fair Trading Act 2012 (Vic). Under these laws you may be entitled to a refund, replacement, or resupply of services where the services are not supplied with due care and skill, are not reasonably fit for purpose, or are not supplied within a reasonable time. Nothing in these terms excludes, restricts, or modifies your consumer guarantee rights.

6. Limitation of liability

To the fullest extent permitted by law, our liability for any loss or damage arising from the supply of services is limited, at our discretion, to the resupply of the services or the cost of having the services resupplied. This clause does not apply where liability arises from your consumer guarantee rights under Australian Consumer Law, or from anything else that cannot lawfully be limited.

7. Vehicles left in our care

Vehicles left with us for repair or installation will be treated with reasonable care. You are responsible for removing personal belongings before dropping off your vehicle. Once we notify you that work is complete, we ask that the vehicle be collected within 7 days. Vehicles not collected within a reasonable period may be subject to reasonable storage fees, and where a vehicle remains unclaimed we may act in accordance with the uncollected goods provisions of Victorian law after giving you proper notice.

8. Cancellation and missed appointments

Please provide at least 24 hours’ notice if you need to cancel or reschedule a booked service. Repeated cancellations or non-attendance may result in a reasonable administration fee being applied to future bookings.

9. Privacy

We handle personal information in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your information as described in that policy.

10. Governing law

These terms are governed by the laws of Victoria, Australia. Any dispute arising out of these terms will be resolved in the courts of Victoria, without affecting any non-excludable rights you may have.

11. Changes to these terms

We may update these terms of service from time to time. The current version will always be published on this page with the date of the most recent revision. Continued use of our services after an update constitutes acceptance of the revised terms.

12. Contact us
